Terms and Conditions for the Online Shop "Bao Gao Club"

1. **Scope**

The following General Terms and Conditions (GTC) govern all orders and contracts concluded through the online shop "Bao Gao Club." Deviating conditions of the customer shall not apply unless their validity has been expressly agreed upon in writing.

2. **Contracting Party**

3. **Conclusion of Contract**

The presentation of products in the online shop does not constitute a binding offer. The customer makes a binding offer by completing the order process in the online shop and finalizing the order by clicking the "order" button. The contract is only concluded when Bao Gao Club accepts the customer's offer by sending an order confirmation via email.

4. **Prices and Payment Conditions**

The prices stated in the online shop are inclusive of statutory value-added tax. Payment can be made by bank transfer, credit card, or PayPal. In the case of bank transfer, the customer will be provided with the bank details. The order is not confirmed until the bank transfer has been successfully received by Bao Gao Club UG

5. **Delivery**

Delivery will be made within the time slot selected by the customer during the order process, provided that the order is placed at least 2 days in advance by 6 p.m. Statements regarding delivery or performance times are to be understood as approximate dates and not fixed dates. Binding delivery or performance dates (fixed dates) must be expressly designated as binding or fixed.

Unforeseeable or unplannable obstacles (construction sites, traffic jams en route to the customer) for Bao Gao Club UG (limited liability) lead to a corresponding extension of any delivery periods at the customer's risk.

Bao Gao Club UG (limited liability) is obligated to make one delivery attempt or an attempt to deliver. Additional attempts or waiting times are to be reimbursed by the customer.

6. **Right of Withdrawal (Return Policy)**

The customer has a statutory right of withdrawal of 14 days. The withdrawal policy can be accessed on the online shop's website. Pursuant to § 312g para. 2 no. 2 of the German Civil Code (BGB), goods are excluded from return if they are products that can quickly perish or whose expiry date would be quickly exceeded.

Requests for return must be made in writing by email to info@baogaoclub.de and must be confirmed in writing by Bao Gao Club UG (limited liability) to be valid.

7. **Warranty**

Statutory warranty provisions apply.

8. **Liability**

Bao Gao Club UG (limited liability) is liable for intent and gross negligence in accordance with statutory provisions. In the case of slight negligence, Bao Gao Club UG (limited liability) is only liable if a fundamental contractual obligation (cardinal obligation) is violated. In this case, liability is limited to the foreseeable, typical damage for the contract.

9. **Data Protection**

The privacy policy is accessible on the online shop's website.

10. **Cancellation Policy**

Cancellation of orders is only possible under the following conditions:

a. Free cancellations are possible up to 7 days before the agreed delivery date.

b. For cancellations made less than 7 days before the delivery date, Bao Gao Club UG (limited liability) reserves the right to withhold 30% of the order amount as a cancellation fee.

c. Cancellations made between 2 and 6 days before the agreed delivery date are subject to a cancellation fee of 50% of the order amount.

d. For last-minute cancellations within 48 hours of the delivery date, Bao Gao Club UG (limited liability) reserves the right to withhold 80% of the order amount as a cancellation fee.

Cancellations must be made in writing by email to info@baogaoclub.de and must be confirmed in writing by Bao Gao Club UG (limited liability) to be valid.

11. **Final Provisions**

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from this contract is the registered office of Bao Gao Club UG (limited liability), provided the customer is a merchant, legal entity under public law, or special fund under public law. If individual provisions of this contract are or become invalid, the validity of the remaining provisions remains unaffected.
